Terms and Conditions
DEPOSITS & PAYMENTS:
All bookings are securely made through our online booking system. There are two categories that our trips fall into: ‘signature journey’ & ‘exclusive expedition’
Upon selection of a trip, depending on trip category, you are required to pay a non-refundable deposit of $1,000 for (1 person) $2,000 for (2 person) or $3,000 for (1 person) $6,000 for (2 person).
This will be confirmed, with a non-refundable final payment of the entire balance due no later than 90 days before the trip departure date, unless otherwise stated. For bookings made 90 days or sooner before trip departure date, the entire trip cost must be paid when the booking is confirmed and is non-refundable.
REFUNDS & CANCELLATIONS:
Your full payment for a trip constitutes consent to all provisions. Tolve Travel reserves the right to cancel a trip at any time for any reason if there are too few participants or if the quality of the trip, safety, and comfort of travelers is at risk.
A refund of all payments received will constitute full settlement. Tolve Travel is not responsible for any loss incurred on travel arrangements or air due to a trip cancellation. Itineraries are subject to change and modified at any time at Tolve Travel’s discretion, traveler will be notified.
If the traveler or travelers choose to cancel, prior to 60 days before departure, there may be the option to apply the non-refundable deposit towards another trip. Please inquire directly.
For any cancellations within 60 days prior to departure there is no refund option. Travel insurance is highly recommended, and Tolve Travel will comply with any travelers insurance cases.
TERMS & CONDITIONS:
In consideration of being permitted to participate on a Tolve Travel trip, (referred to herein as “trip”), I hereby acknowledge, and agree to the following terms and conditions:
All bookings are made with Tolve Travel and the owners of all its advertised itineraries (“Tolve Travel,” “TT”, “we,” or “us”). By booking a trip with us and paying a non-refundable deposit you accept all of the terms in this agreement on your own behalf and on behalf of all persons listed on the booking (individually, “Traveler,” and collectively, “Travelers”). The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the Traveler (“you” or “your”) and Tolve Travel with respect to any and all bookings, reservations, trips, or transactions made with Tolve Travel. By acknowledging this Agreement, you also agree to our Health & Code of Conduct.
Please read the following carefully:
a. Travel Insurance
Tolve Travel highly encourages comprehensive travel insurance for all Travelers. It is solely the responsibility of the Traveler to secure such coverage, if he/she/they chooses to do so. If the Traveler chooses to obtain travel insurance, Tolve Travel recommends that it covers trip cancellations, trip interruptions, medical emergencies abroad, emergency evacuation, loss of baggage or personal items and flight delays.
b. Passports and Visas
Each Traveler is required to carry a valid passport and obtain all required visas and/or permits for countries visited. All passports must be valid for 6 months beyond the duration of your trip. For example, if the Traveler (departs/returns) on January 1, his/her passport must be valid until at least June 2. Tolve Travel are not responsible for travel interruptions or cancellations due to the Travelers failure to obtain or secure proper travel documentation prior to departure.
By agreeing to Tolve Travel Terms and Conditions, the Traveler gives Tolve Travel permission to use photos taken of him/her/they during the trips for promotional purposes and in any other medium Tolve Travel chooses.
d. Optional Activities
Throughout the course of each trip there will be opportunities to participate in additional and optional activities including but not limited to hiking, surfing and guided walking tours. The dangers associated with these activities as well those generally inherent to the trip location are accepted by the Traveler at his/her/their own risk. Any assistance given by group leader or local representative in organizing these activities shall not result in any liability of Tolve Travel for any bodily injury, illness, or death arising out of, resulting from, related to, and/or caused in whole or in part, by the Travelers involvement in these optional activities.
e. Health & Code of Conduct
The right is retained to decline to accept or to retain any person as a traveler should such person’s health, mental condition, physical infirmity or attitude jeopardize the operation of the trip or the rights, welfare, or enjoyment of other travelers.
Each of the Tolve Travel destinations have cultural customs unique to each region including attire, food, drink and other social aspects. Travelers shall research on his/her/thier own as well to ensure they are prepared. Tolve Travel does not tolerate illegal drug use and respectfully asks that each Traveler of age to do so, consumes alcohol responsibly. Tolve Travel reserves the right to remove a Traveler from a trip if he/she/they is found to be engaging in and/or using any illegal activity or drug and/or hazardous, intolerable behavior. Such removal shall be at the Travelers own financial expense. Should a traveler choose to leave voluntarily, Tolve Travel will require a signed statement indicating the traveler’s decision to voluntarily leave the trip and Tolve Travel will not be responsible in any way for the traveler’s expenses to return home.
Please check with your health care provider to ensure that you have the required inoculations, if any, and that you carry such proof of inoculation on a valid vaccination certificate where required.
f. Acceptance of Risk
Tolve Travel want each traveler to experience an unforgettable exploration and adventure of discovery, both personal and cultural. Therefore, Tolve Travel’s itineraries and trips involve an inherent degree of personal risk based on cultural, political, and geographical attributes relevant to our destinations. Tolve Travel gathers information from foreign departments as well as our own local contacts to make itinerary decisions; however, it is ultimately the Travelers responsibility to familiarize himself/herself/them with relevant travel advisories and information. Visit the U.S. State Department at www.travel.state.gov for updated travel warnings and advisories prior to departure. By booking a trip with Tolve Travel, the Traveler acknowledges that he/she/they is aware of associated risks with such unique travel and agrees to release, indemnify, and hold harmless Tolve Travel from any and all liability and responsibility arising out of, resulting from, related to, and/or caused in whole or in part, by bodily injury, illness, or death, whether such was the result of intentional or unintentional acts.
g. Forum and Governing Law
By agreeing to these Tolve Travel Terms and Conditions, the Traveler acknowledges that he/she/they is contracting with a business incorporated in the State of Pennsylvania. Thus, any legal action that may arise from this Agreement shall be exclusively litigated in the state of Pennsylvania. This Agreement shall be interpreted and construed according, and governed by, the laws of Pennsylvania excluding any such state or international laws that might direct the application of the laws of another jurisdiction.
“Agreement” shall mean these Terms and Conditions between Tolve Travel llc and the Traveler “Traveler” or “Travelers” shall mean the client of or individual receiving travel services pursuant to this Agreement; “Tolve Travel” refers to a company operating and licensed in the State of Pennsylvania. “Personnel” shall mean the members, employees, agents, and/or representatives of Tolve Travel llc who are to be engaged in providing the travel services.
By booking a trip, or contracting travel design services, the Traveler or Travelers, agrees to these Terms and Conditions. This document constitutes the entire agreement between the Traveler and Tolve Travel and your booking and/or travel design services will be accepted on this basis.
